Andrew Updegrove has a broad range of experience in representing both mature and emerging high technology companies of all types in all aspects of their legal affairs. Since 1988, he has also represented and helped structure more than 80 worldwide standard setting, open source, promotional and advocacy consortia, including some of the largest standard setting organizations in the world.  He spends a significant part of his time giving strategic advice to clients of the firm.

His awards include being recognized as: one of the top 100 attorneys in Massachusetts in each of the annual peer surveys (2004 - 2006) of all attorneys in the state conducted to date by Law and Politics; one of 13 “Mass All Stars” chosen in 2003 by Mass High Tech, the Journal of Technology in New England; and one of the "Best VC Lawyers" in Boston by the Digital Industry News in 2001. In 2004, he was the sole representative of the consortium community to be appointed as a member of the United States National Standards Strategy Committee. Most recently, he received the 2005 President’s Award for Journalism from the American National Standards Institute (ANSI) for his work at ConsortiumInfo.org and the Consortium Standards Journal, which he created in 2002.

His leadership in furthering all aspects of the standard setting infrastructure, from traditional accredited organizations, to consortia, to open source projects, is widely recognized. In 2005 he was elected to the Boards of Directors of ANSI and the Free Standards Group (FSG), and in 2007 to the Board of Directors of the Linux Foundation, where he also serves as Director of Standards Strategy.  Together, these organizations cover the full range of collaborative technology endeavor: ANSI accredits almost 200 standards organizations and represents the United States in global standard setting activities, while the Free Standards Group, a nonprofit organization that combined the efforts of both the open source development community and major IT vendors, was formed to develop the standards needed to prevent the fragmentation of Linux (and other key open source software) in the way that destroyed the interoperable value of UNIX. The Linux Foundation is the product of the merger of FSG and Open Source Development Labs (OSDL), and provides a range of support services to protect and promote the further development of the Linux ecosystem.  He is also a member of the Board of Advisors of HL7, an ANSI accredited developer of electronic health standards for clinical and administrative data.

Although in recent years he has divided his time evenly between representing technology companies and standard setting and open source organizations, the greatest part of his time over more than 25 years in practice has been spent counseling emerging high technology and other fast growth clients. He has advised many hundreds of startup companies with respect to their strategic and legal needs, assisting them in their progress from a concept to a mature company. In the course of this representation, he has critiqued their business plans, advised on structuring their businesses, introduced them to financing sources, represented them in angel, venture capital, bank and public financings, advised them on behalf of their intellectual property programs, negotiated mergers and acquisitions on their behalf, and assisted them in many other aspects of their legal and business affairs.

He has also represented mature companies in many areas, including with respect to financings, mergers and acquisitions, the redeployment of services and assets onto the Internet, and complex intellectual property matters. He is a frequent speaker on the topics of financing, emerging company issues, and mergers and acquisitions.

In the consortium area, he has been retained by many of the largest technology and technology dependent corporations in the world to assist them in setting up international standard setting and technology promotional organizations. He has also advised Fortune 500 companies and governmental agencies with respect to setting internal standards setting policies and goals. Recognized internationally as an expert on the topics of standard setting, intellectual property policies and consortia, he has written and spoken widely, as well as provided testimony to the Department of Justice and Federal Trade Commission, on these topics. He has also written and filed pro bono “friend of the court” briefs in major standards-related litigation before the Federal Circuit Court, the Supreme Court, and the Federal Trade Commission.

In May of 2002, he conceived and launched ConsortiumInfo.org, a more than book-length website sponsored by the firm which is intended to provide the most comprehensive and detailed source of news and information on (or off) the Internet on standard-setting, open source software project development, and forming and maintaining consortia.  The site serves up to a million page views a month to a global audience.  In December of 2002, he conceived and launched the Consortium Standards Bulletin, a monthly eJournal of news, ideas and analysis on the topics of consortia and standard setting. The CSB is sent to a large and rapidly growing list of subscribers at major corporations, government agencies and universities throughout the world. Other sections of the site include the Standards MetaLibrary, with over 1,000 categorized and abstracted articles, and the Standards Blog, which attracts up to 100,000 visitors a month. Besides his efforts at the ConsortiumInfo.org Website, he writes and speaks frequently both domestically and internationally on topics involving standards, open source software and consortia.

Mr. Updegrove is a graduate of Yale University and the Cornell University Law School. He is a certified mediator, and is a member of both the Panel of Mediators of the Massachusetts Software and Internet Council and the World Intellectual Property Organization (WIPO) Arbitration and Mediation Center's List of Arbitrators, Mediators and Experts. Outside the office, he has been a director of the Gloucester Stage Company, the Treasurer and a Director of the Vinalhaven [Maine] Land Trust, and the Moderator of the Old North Church in Marblehead. In a prior life, he was the founder and owner of a successful architectural stained glass studio.  He continues to be the adoring father of a 16 year-old daughter and the loving husband of a wife whose age is better left unstated.
